HIPs receive (yet) another painful blow

So, first home condition reports were dropped because buyers/lenders couldn't trust the results... and a watered down HIP (energy performance certificate - search - evidence of title) came into force for vendors of homes of four or more bedrooms, supposedly speeding up the process and making life easier for buyers. Last night it emerged that the search might not be up to snuff either. Apparently, the personal (rather than full) search included in the packs is too unreliable to satisfy some lenders. Mortgage companies and (surprise, surprise) solicitors are advising clients to pay for a full local authority search. The upshot is that some buyers will be paying for both (a full search on the property they're buying, a flawed HIP on the property they're selling) and everybody involved in the transaction will still have to wait for the full search to be completed. So - for up to £500 - a HIP is now a piece of paper which (if you're lucky) will tell you how many energy efficient lightbulbs are in the house, and evidence of title. Bargain.

Odd that solicitors should bring this up. I have used personal searches for more than 3 yrs - by firms recommended by my solicitor!

LMS are one of the largest search companies in the world and will probably be used by 70% of pack providers. Their insurance backed searches are more than adequate - and will be extended to 6 months soon.

The only reason solicitors and pack providers use personal searches is because they are cheaper and quicker than local authority searches. Who wants to wait up to 12 weeks for a LA search when one can be returned in 3 days?

The CML originally approved personal searches for HIPs with the ultimate aim of HCR's and valuations all been thrown in as well.

Why should the Law Society want to bring this up now? They were late to jump on HIP opportunities and are now trying to find ways to make their product the only 'real' option. They've known about HIPs for 10 yrs and want to bring this up now!?

Comments about the problems associated with personal searches underline the importance of home owners commissioning their own Home Information Packs and not relying on �free� or �subsidised� Packs.

HSBC and other lenders have been incorrectly quoted as saying that they will not now accept personal searches provided by a vendor as part of their Home Information Pack. In fact, as both the Law Society and RICS have said in the dry runs for HIPs, the problem is with the personal search itself which in many cases is purely an insurance policy based upon an online questionnaire. It doesn�t even require a visit to the local authority. In fact the situation for lenders hasn�t changed which traditionally has been that a lender has asked the buyers lawyer, who is also acting for them, to stand behind a personal search if one is done.

Understandably, buyers� solicitors might be reluctant to put their credibility and insurance behind a search that they have not done or commissioned themselves.

What we are seeing here is yet another example of the importance of commissioning your own HIP when you come to sell. This way you can be sure that the EPC element as well as the legal work that goes into the Pack reflects everything necessary for both you and a potential buyer. As with any legal document, it�s worth checking with your lawyer.

For the time being, the additional cost and time that will be required to obtain authenticated searches won�t impact on sales but form next year, when Packs have to be prepared before a property is marketed, we are bound to find some people having to wait before they can sell their house.
